2009 Year-to-Date Scorecard:
Since the start of the year, we have activated the Berman and Company grasstops network on minimum wage,
paid sick leave, and menu labeling bills. So far, these issues have come up the most frequently in the state
legislatures, and we have created 37 activations in 20 separate states in response (see below). While many state
legislative sessions are still in full swing, due to the economy and concerns from companies like yours, a number
of bills have stalled or been defeated because legislators know that now is not the time for additional costs on
employers.

In addition, because of the political balance in Washington, concerns are that these labor and food mandates
will be replicated at the federal level. We are closely monitoring these proposals, including EFCA, paid sick leave, health care, and menu labeling, in the event a federal grassroots activation would be effective.
