BPAA's Smoking Ban Resource Guide

Smoking Legislation

Enacting a local smoke free indoor air law is thought by some to be the best way to protect people from secondhand smoke exposure.  Others question the validity of the dangers of second hand smoke in supporting a freedom of choice issue.

When discussing smoking ban legislative proposals, things to consider are:

  • Do they create unfair competitive advantages to other similarly situated businesses outside of the boundaries proposed to be affected?
  • Do they allow for a time period for businesses and smokers alike to adjust?
  • Is the legislation flawed by allowing a number of exemptions, such as stand alone taverns, casinos, nonprofit clubs, etc.?

PAA serves as a resource to its state and local affiliates and supports their position taken on this issue.
